These general terms and conditions of sale (hereinafter the "GTC") govern the commercial relations between ABBIE AND ROSE and any purchaser (hereinafter the "Purchaser") of ABBIE AND ROSE brand products (hereinafter the "products") on the Website.

The validation of the order of a Product offered for sale on the Website implies the express, total and unconditional acceptance of the General Terms and Conditions of Sale, which is expressly recognized by the Purchaser, who renounces in particular the right to take advantage of any contradictory document that would be unenforceable against ABBIE AND ROSE.

The GCS applicable to an order are those in force on the day of the confirmation of the order by the Buyer.

The GCS are accessible at any time on the Website and will prevail, if necessary, over any other version or any other contradictory document.

The purchase of the Product is forbidden to minors under 18 years of age and to persons incapable of entering into a legal contract.

The Purchaser guarantees the accuracy of the information it provides on the Website.

Purchases made on the Website are solely for the Buyer's personal use, or intended to be offered, and may not be used for resale.

The Products are all the goods offered for sale by ABBIE AND ROSE on the Website.

The Products offered for sale on the Website are valid while stocks last.

ABBIE AND ROSE makes its best efforts to ensure that the photographic representation of the Products on the Website is as faithful as possible to the Products themselves. However, in view of the digital presentation of the Products on the Internet network, it is possible that the perception of the photographic representation of the Products by the Purchaser may not correspond exactly to the Products themselves. The utmost care is taken in the presentation of the Products on the Site in order to meet the requirements of article L.111-1 of the French Consumer Code.

Buyers have the possibility to order on the Website at www.abbieandrose.com.

To proceed with the purchase of Products, the Buyer goes to the page of the Product of his choice and clicks on the tab "ADD TO CART", then goes to the space "MY CART" and clicks on "ORDER".

The Buyer then indicates a billing address and a delivery address.

A summary of the order appears and the Buyer can view the details of his order and its price.

Before the final validation of his order, the Buyer has the possibility - at any time - to view and modify the items placed in the space "MY BASKET" by clicking on this tab.

The Buyer must then validate his order to proceed with payment.

In order for his order to be validated, the Buyer must also read the General Terms and Conditions of Sale and tick the box "I declare that I have read and fully and unreservedly accept all the General Terms and Conditions of Sale".

Once the order has been validated, the Buyer receives, automatically and without delay, an email confirming his or her order, including a summary of the items ordered and a copy of the GCS. This email confirms that ABBIE AND ROSE has received the Purchaser's order, but does not constitute confirmation of the availability of the Products ordered.

The Buyer will receive a second email when the items are ready to be shipped, which will be a confirmation of the availability of the items ordered.

In the event of total or partial unavailability of the Products after placing the order, the Purchaser will be informed by email of partial delivery or cancellation of his order.

In case of unavailability of the Products, the Buyer has the right to be refunded the price of the unavailable Product ordered within fourteen (14) days following his request.

During the sales period, the operations organized by the ABBIE AND ROSE brand cannot be combined with discount vouchers, credit notes, gift vouchers and promotions.

The price of the Products is indicated on the Website, all taxes included. The shipping costs of the Buyer's order will be indicated to him/her before the final validation of the order. In addition, once the order has been validated, the prices and costs will remain accessible in the "Order History" section in the "My Account" area accessible on the Website.

For deliveries outside the French territory, the provisions of the General Tax Code regarding VAT will be applicable.

Payment for the Products must be made by credit card or via Paypal, as indicated on the payment page.

The following credit cards are currently accepted: credit card, visa and mastercard.

The entire price, including shipping costs, will be debited from the Purchaser's payment card or Paypal account at the time of shipment of the products ordered.

The Buyer guarantees that he is fully entitled to use the payment card or Paypal account for the payment of his Order and that this means of payment gives access to sufficient funds to cover all the costs of his order.

If the card provider refuses to authorize the payment, or if the Paypal account is not sufficiently funded, the order will not be validated and the goods will not be delivered. In this case, ABBIE AND ROSE will send an email to the Buyer to inform him/her of the refusal.

Payment card transactions are handled by CREDIT AGRICOLE's secure payment system.

All information that Buyers communicate to ABBIE AND ROSE is strictly protected and guarantees the conformity and security of each transaction.

In the event of non-compliance by the Buyer with the obligations subscribed to under the terms of the GCS, and in particular in the event of fraud or any attempt at fraud, and any incident of payment of the price of the order, ABBIE AND ROSE reserves the right to refuse any order from the Buyer with whom there is such a dispute.

The prices of the Products are those of the price list in force on the day of the validation of the order.

The prices of the Products are indicated on the Website in Euro and are inclusive of VAT. (all taxes included including VAT at the legal rate in force).

Prices are guaranteed subject to typographical error.

The prices of the Products indicated on the Website are exclusive of delivery costs.

The products purchased are payable in full cash on the day the order is placed. The delivery of the Product will take place only after payment in full of the product. Delivery means the transfer to the consumer of physical possession or control of the goods.

Promotional codes (sponsorship code, birthday code, ...) and credit notes cannot be cumulated with the sales period. Moreover, credit notes and promotional codes cannot be combined with each other.

6.2.1 - Free delivery charges

Delivery charges for delivery in COLISSIMO in Metropolitan France, including Corsica, Andorra, and Monaco are free of charge.

6.2.2 - Shipping fees to be paid

Delivery charges for a delivery in COLISSIMO INTERNATIONAL are payable.

The delivery costs are then indicated all taxes included during the validation of the order.

These delivery charges are in addition to the prices indicated for the Products. Before the final validation of the order, the customer is informed of the totality of the price to be paid.

Amount of delivery costs :

- from 9.5 euros, depending on the destination and weight of the package, by COLISSIMO INTERNATIONAL.

Orders are delivered in specific packaging to guarantee their condition during the transport of the Products.

ABBIE AND ROSE delivers its Products in metropolitan France, including Corsica, in Europe, and in countries outside the European Union.

Any contribution to shipping costs is inclusive of all taxes.

The Products are sent to the delivery address specified by the Buyer during the ordering process, ABBIE AND ROSE cannot be held responsible in the event of an incorrect or incomplete address indicated by the Buyer.

In the event that the Buyer's order relates to several Products, ABBIE AND ROSE reserves the right to send them to the Buyer in several installments.

The Products acquired by the Buyer are generally delivered within two (2) to three (3) working days in metropolitan France. In all cases, the Products are delivered within a maximum of fourteen (14) days from the date of receipt of the order confirmation e-mail.

ABBIE AND ROSE undertakes to use its best efforts to deliver the Products ordered by the Purchaser within the time limits specified above.

If the aforementioned period of fourteen (14) days is exceeded, the Purchaser may request the immediate cancellation of the sale by sending a registered letter with acknowledgement of receipt to the address 2 Rue André Ampère Batiment C10 - 17180 Périgny or an email to the following address sav@abbieandrose.com, and obtain a refund of the sums paid in respect of his order.

The amounts paid by the Buyer will then be returned to him without delay, and at the latest within fourteen (14) days following the date on which the contract was terminated.

In application of article 1218 of the Civil Code, ABBIE AND ROSE cannot be held responsible or considered as having committed a fault in the processing of the Buyer's file, if any delay or non-performance results from a case of force majeure as defined by the French Courts.

After receipt of the order, the Customer is invited to check the state of the packaging and the conformity of the Products delivered and to immediately notify any anomaly by sending an e-mail to sav@abbieandrose.com.

Only products that have been purchased on the WebSite www.abbieandrose.com are concerned by the right of withdrawal.

The Customer shall have the right to retract and return the Products ordered within a period of fourteen (14) days following the receipt of the parcel. In the case of an order comprising several Products delivered separately, the period shall run from the date of receipt of the last Product. By complying with the terms and conditions set out below:

a- the products will be returned in a state allowing their transport after request of the return form to the customer service sav@abbieandrose.com.

b- the products will be in their original condition, without having been damaged, stained, washed, modified or worn (except for fitting), with the original packaging and all accessories relating to the products, such as packaging, labels, and the original invoice. If the withdrawal period of fourteen (14) days expires on a Saturday, Sunday or holiday, this period is extended to the next working day. Only intact products, i.e. in their original state (in their packaging and unopened), will be accepted.

For any purchase made on www.abbieandrose.com, requests for withdrawal, regardless of the method of delivery, must be sent to us at this email address sav@abbieandrose.com, or by any other means of your choice explicitly expressing your desire to withdraw.

According to the provisions of Article L 121-21-4 of the Consumer Code, we will refund the price of the products in your order as well as any delivery charges at the standard rate, by re-crediting the payment method used for your initial order.We will make this refund as soon as possible and at the latest within fourteen (14) days following receipt of the goods you have returned to us.

You have a period of fourteen (14) days following receipt of your order to inform us of your wish to return all or part of your order.

In order to return the Products, the Buyer must notify ABBIE AND ROSE of his intention as well as the reasons for this return on this email address sav@abbieandrose.com. Once your return request has been validated by ABBIE AND ROSE, carefully prepare your package by inserting your "delivery slip", if you have lost it, please contact customer service. ABBIE AND ROSE will then send (at the time of the first exchange) a prepaid postage label by e-mail for the assumption of shipping costs by ABBIE AND ROSE. When returning for a refund or for a second exchange the postage is at the customer's expense.

The return or exchange is at the Customer's risk. The Product must be returned within fourteen (14) days in its original condition, new, unworn, unwashed and carefully folded in its original packaging.

The Products must be returned by COLISSIMO to the following address:

At reception of the parcel, ABBIE AND ROSE will objectively judge the condition of the returned goods. No return or exchange will be accepted if the returned item(s) have been obviously used or damaged in another context than the Buyer's fitting and that this use or damage makes the Products unfit for sale. If the return or exchange is refused by ABBIE AND ROSE, the Products will then be returned to the Buyer, the return costs will be at the Buyer's expense.

During the first exchange, no return costs are charged to the customer in metropolitan France (Corsica, Monaco and Andorra included). The return costs are the standard delivery costs of the products ordered and received by the Purchaser and returned to ABBIE AND ROSE.

The customer is responsible for the return costs:

in the event of a request for exchange outside metropolitan France in the event of a request for refund in metropolitan France and outside metropolitan France.

Beyond one (1) exchange, returns for exchange are accepted by ABBIE AND ROSE, but the return and shipping costs of the new order are at the customer's expense. The return costs include postal charges. The return costs will be taken in charge in case of non-conformity or error on the part of ABBIE AND ROSE.

If the conditions set out in article 7 above are met, ABBIE AND ROSE will, at the customer's choice, refund the price of the returned products or issue a credit note (voucher) for exchange, valid for 1 year on the Website.

In the event of a request for reimbursement by the Buyer, ABBIE AND ROSE will, within fourteen (14) days from receipt of the returned products, re-credit the means of payment used for the initial order corresponding to the price of the returned products.

In the event of a request for exchange, ABBIE AND ROSE will issue a credit note (voucher) for the Buyer, ABBIE AND ROSE will send the latter by electronic means, within fourteen (14) days from receipt of the returned Products, this credit note is valid for one (1) year on the Website and corresponds to the price of the returned Products.

Customers who have received a promotional code and wish to redeem later will receive a credit note for the net amount paid. If the discount is no longer valid or cannot be accumulated, the sum equivalent to the discount received on the first purchase must be paid in order to exchange the product ordered.

In the case where an order has been paid for with a discount voucher, the value of the discount voucher will be deducted from the amount of the refund or credit issued by ABBIE AND ROSE in proportion to the number of Products ordered. In the event of a request for exchange by the Purchaser, this request depends on the availability of products in stock.

The Buyer is informed that following an exchange, the Buyer may not request a refund of the exchanged products but only proceed to a new exchange or request the issuance of a new credit voucher.

When an order has been paid for by means of a credit note, the products returned can no longer be reimbursed by ABBIE AND ROSE. Only the exchange of returned products or the issue of a new credit note by ABBIE AND ROSE will be authorized. The Purchaser is furthermore informed that the credit notes issued by ABBIE AND ROSE are neither securable nor refundable.

ABBIE AND ROSE is committed to respecting the confidential nature of the personal data communicated by the Purchasers on the Website and to processing them in accordance with the provisions of the French Data Protection Act of 6 January 1978 and Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data. Personal data collected on the Website will be processed in accordance with ABBIE AND ROSE's Personal Data Management Policy. In accordance with the regulations in force, the Purchaser has the rights mentioned in the Policy for the management of your personal data which he may exercise : - through his customer account - by e-mail, accompanied by a copy of any identity document: sav@abbieandrose.com. - by mail, accompanied by a copy of any identity document by contacting Customer Service ABBIE AND ROSE 2 Rue André Ampère - Batiment C10 - 17180 PERIGNY.

ABBIE AND ROSE cannot be held responsible for delays or breaches of obligations under the terms of the GCS in case of force majeure within the meaning of the jurisprudence of the French Courts.

ABBIE AND ROSE cannot also be held responsible for any inconvenience or damage relating to the use of the Internet network and the Website (rupture in the service, computer viruses, external intrusions...).

The Buyer benefits from the legal guarantee of conformity and the guarantee against hidden defects, in accordance with the provisions of articles L.217-4 and following of the Consumer Code and 1641 and following of the Civil Code.

If the Products delivered by ABBIE AND ROSE present a lack of conformity existing at the time of delivery or a hidden defect, the Buyer is invited to contact ABBIE AND ROSE as soon as possible by sending an email to sav@abbieandrose.com.

Within the framework of these guarantees, ABBIE AND ROSE undertakes, as far as it is possible to do so, to :

- replace the Product by an identical or equivalent Product according to the available stocks,

- or to exchange the Product for a Product of equivalent price according to the available stocks,

- either to refund the price of the Product ordered within fourteen (14) days of the Purchaser's request if replacement by an identical or equivalent Product has proved impossible.

All the elements present on the Website www.abbieandrose.com are protected by copyright, trademark law, design law and/or any other intellectual property right.

These elements belong to ABBIE AND ROSE or are used with the agreement of their owners.

The reproduction or representation of these elements, without the express prior written consent of ABBIE AND ROSE, constitutes acts of counterfeiting punishable under the Intellectual Property Code and the Penal Code.

The Website that is made available to the Buyer is intended solely for his personal and private use and not for commercial use. The content of the Website may not be used for any other purpose whatsoever without the prior, express and written consent of ABBIE AND ROSE.

The General Terms and Conditions of Sale are governed by and subject to French law.

The GCS are governed by and subject to French law. In case of dispute, an amicable solution will be sought and favored before any legal action. Failing this, the French courts are territorially competent to hear any dispute relating to the website www.abbieandrose.com and the orders placed on it.

Since January 1, 2016, Articles L 612-1 et seq. of the French Consumer Code grant you the right to use a consumer mediator for the amicable resolution of a dispute between you and a professional. Before using the said mediation service, please remember that you must have contacted our Customer Service Department by e-mail at the following address sav@abbieandrose.com. As long as you have not first contacted our Customer Service to try to find an amicable solution to your dispute, the mediation service referred to in this article cannot be referred to.
